Context and Background

A multinational enterprise was preparing a valuation study in connection with the transfer of intellectual property. The initial study had been drafted internally by the client, with extensive assistance from AI.

While AI had helped create a substantial starting point, the study still required further review and development before it could support the proposed IP transfer.

Several statements that appeared to be factual were not yet sufficiently supported by the underlying materials. Certain conclusions generated with the assistance of AI also went beyond what could be substantiated by the report, available studies and other supporting information.

Most importantly, the initial valuation outcome was not sufficiently robust to be accepted by the transferee.

Quantera Global worked closely with the client to review, challenge and strengthen the existing IP valuation study.

Rather than starting again from scratch, the focus was on identifying where the AI-assisted analysis provided a useful foundation and where additional professional judgement, evidence and valuation work were required.

This included critically reviewing statements presented as facts, assessing whether conclusions were adequately supported by the available materials and strengthening the underlying valuation analysis.

Through close collaboration with the client, the study was developed into a more robust and substantiated report that met the quality standards required for the transaction.

Strategic Challenges 

The project involved several important challenges:

• Distinguishing between statements that were adequately supported and those that appeared factual but lacked sufficient underlying evidence.
• Identifying AI-generated conclusions that went beyond what could be substantiated by the available analysis and supporting materials.
• Strengthening the valuation methodology and underlying analysis.
• Addressing an initial valuation outcome that was not sufficiently robust to be accepted by the transferee.
• Preserving useful elements of the client’s existing work while bringing the overall study to the required quality standard.

The project also demonstrated an increasingly relevant challenge for tax and transfer pricing professionals: AI can significantly accelerate parts of an analysis, but its output still requires careful validation against source materials and professional judgement.

Outcome delivered

Through close collaboration, Quantera Global and the client significantly strengthened the IP transfer valuation study.

Unsupported statements and conclusions were identified and addressed, the supporting analysis was enhanced and the valuation was developed into a more robust basis for the IP transfer.

Instead of replacing the work that had already been completed, the engagement built on the useful elements of the AI-assisted draft while adding the substantiation, critical review and professional judgement required for a complex IP valuation.

Why This Matter Was Significant

The project illustrates both the potential and the current limitations of AI in complex transfer pricing and valuation work.

AI can provide a valuable starting point and support the preparation of sophisticated analyses. However, a well-written or convincing conclusion is not necessarily a substantiated conclusion. For an IP valuation, statements and assumptions ultimately need to be supported by the underlying facts, materials and analysis.

This case therefore went beyond strengthening an individual valuation study. It provided a practical example of how AI and specialist expertise can complement each other, with AI supporting efficiency and professionals providing the critical review, validation and judgement required to produce a robust outcome.
